A. Registration and Profile Information: As part of the registration process, you will be asked to provide information including, but not limited to, a phone number, an e-mail address and your name. If you elect to purchase a premium service, our billing partners, Apple, Google and Stripe may collect billing and payment information from you. From time-to-time, Service may include functionality that permits you to provide profile information that may be accessible by recipients that you designate. This profile information may include, but is not limited to: age, height, weight, personal photo, hair color, eye color, gender, emergency contact information, allergies, ethnicity, primary physician’s name and phone number, and other information that may be of assistance to people responding to an incident you initiate through Service. You may also have the ability to submit multimedia content which includes other information that does not specifically fall within categories offered by Service account management tools. When you use Service, we will not collect any of the foregoing personally identifiable information about you unless you provide it to us voluntarily. When you create your personal profile of information, you will be asked for both personal and demographic information, some of which is required in order to complete the registration.
B. Incident Information: When you use Service to transmit any information pertaining to an incident (including video, audio, text and other data), ArmourGrid will collect such information.
C. Geo-Location Information: Unless you disable the geo-location functionality of the application or your mobile device, Service will track your location and associate/store such location with any messages, data or incidents that you transmit through Service. We also collected the location of your assigned “Geo Fences” so that we can alert designated Contacts of your entry into and exit from those Geo Fences.
D. Driving Data: We may collect various sensor data such as data generated by gyroscope, GPS, accelerometer and compass for analytics purposes.
E. Device Usage Data: One of the functions of our Service is to collect and analyze the device usage data, on your behalf, of your designated Contacts. These designated Contacts have given you explicit consent to monitor their device usage data. In such case, we deploy the configuration and the instructions provided by you and you are solely responsible for the configuration of the device usage data extraction and analysis from designated Contacts’ devices. In such cases, on your behalf, we collect various device data including but not limited to application profiles and usage, online interactions, phone calls, texts and device software details.
F. Passive Information Collection: As you navigate through Service, certain information can be passively collected (that is, gathered without you actively providing the information) using various technologies, such as navigational data collection. For example, when using Service, we and/or our service providers may track Internet Protocol addresses, use session and persistent cookies, use session IDs and assign Internet tags. Our system may also automatically gather information about the application areas you visit on Service and collect operational information about the technology you use, such as your browser, operating systems, IP address, system and application software, peripherals, Internet service providers and the domain name of the web site from which you linked to Service. In addition, when you view or use Service, we may store some information on your computer or mobile device. This information will be in the form of a cookie, flash cookie or similar file and will help us in many ways. We reserve the right to use, and to permit our service providers to use, such cookies, flash cookies and web beacons, as well as other comparable or future technologies, to collect information regarding usage of Service or our applications (including use of our applications on third party sites). We do not use technology that recognizes a “do-not-track” signal from your web browser. We passively collect information to understand what areas of Service are most popular, which areas may require improvement and what technologies are being used by our visitors. This information helps us to update and improve Service. We also use this information for security purposes, to detect and to block security breaches and to provide you with a safe Service usage environment.
A. Service is not directed to individuals under the age of 13, and we request that these individuals may not register or use the Service. If you are under 13 please do not submit any information to us. Our Service does allow a parent/legal guardian to monitor and safeguard their children’s location, online interactions and device usage. A Parent/Legal guardian wanting to monitor under 13 children, the Parent/Legal guardian must first complete and submit a Parental Consent Form for each child via mail or email to us. B. The Children's Online Privacy Protection Act of 1998 and its rules (collectively, "COPPA") require us to inform Parents about our practices for collecting, using, and disclosing personal information received or obtained from Children. It also requires us to obtain verifiable consent from a Child's Parent for certain collection, use, and disclosure of the Child's personal information. This sub-section notifies Parents of:
(i) Information We Collect From Minors
Children can access many parts of the Service and its content and use many of its features without providing us with personal information. Please see Section 1. “Personal Information We Collect from You” for information on what personal information is collected from all Users, including children. We only collect as much information about a child as is reasonably necessary for the Child to use the Service, and we do not condition his or her usage on the disclosure of more personal information than is reasonably necessary. We may request additional information from your Child, but this information is optional. We specify whether information is required or optional when we request it.
(ii) How do We Use and Disclose Minor's Information We do not use or share personal information collected from the accounts of Children for marketing or advertising purposes or permit our third-party partners to collect and use such information for advertising purposes. We use the personal information that we collect from all Users, including your Child, as described in Section 3. “HOW THE COMPANY MAY USE AND DISCLOSE INFORMATION OBTAINED THROUGH THE SERVICE” below.
(iii) Accessing and Correcting Your Child's Personal Information At any time, you may review the Child's personal information maintained by us, require us to correct or delete the personal information, and/or refuse to permit us from further collecting or using the Child's information.You can review, change, or delete your Child's personal information by:
A. Designated Recipients: During the registration process and through use of account management tools, you may identify one or more recipients (e.g., your family members) to share your location and/or share your device usage and/or share any incidents you elect to initiate through Service (the “Designated Recipients”). When you utilize Service to initiate an incident, you acknowledge and agree that all content in the incident report will be made available to and accessible by ArmourGrid and the foregoing recipients and you have no expectation of privacy in connection therewith. ArmourGrid is not responsible for whether or how those Designated Recipients utilize the content and data that you agree to send and send to them.
B. ArmourGrid Use: Your contact information (e.g., e-mail addresses, phone number) will only be used for the purposes for which you supplied it to us (e.g., responding to your incidents, inquiries comments or requests for information, sending requested newsletters, etc.). Your billing information (credit card number, billing address) will only be used to process transactions between you and ArmourGrid.
Except as otherwise stated, we may use information collected internally (including sharing with employees, contractors, subcontractors, etc.) to operate Service, to improve Service, to customize Service to your preferences, to communicate information to you, for research purposes, for data analysis, audits, fraud monitoring and prevention, for developing new products, conducting surveys, determining the effectiveness of our communications and marketing, enhancing, improving or modifying Service, for identifying usage trends, and operating and expanding our business activities and any other purpose specified in this policy. In addition, we may make full use of all information acquired through Service that is not in personally identifiable form.
C. Other ArmourGrid Disclosures: In addition to the disclosure of your information to recipients and responders as described in clauses 2A, 2B, and 2C above, we may disclose any of the information you provide:
(i) to contractors we use to support our business (such as hosting providers, technical support, web analytics and financial institutions), in which case we will require such third parties to agree to use it for the same purposes; or
(iii) As we believe, in our sole discretion, to be required or appropriate: (a) under applicable law, including laws outside your country of residence; (b) conform to law, to comply with legal process, or investigate, prevent, or take action regarding suspected or actual illegal activities; (c) to respond to a subpoena, (d) to respond to requests from public and government authorities including public and government authorities outside your country of residence; (e) to enforce our Terms of Service, take precautions against liability, to investigate and defend ourselves against any claims or allegations; (f) to protect our operations and the security or integrity of our site; (g) to protect our rights, privacy, safety, or property, and/or those of you or others; and (h) to allow us to pursue available remedies or limit the damages that we may sustain; or
(iv) in situations involving threats to the physical safety of any person. or
ArmourGrid does not otherwise distribute to third parties your personally identifiable information. You agree, however, that ArmourGrid shall have no liability for disclosure of information obtained due to errors in transmission or the unauthorized intervention of third parties.
D. ArmourGrid may de-identify and aggregate your personal information (including, without limitation, usage statistics and geo-location information) with information from other users of Service. ArmourGrid may use or disclose such aggregated information for purposes of operating, modifying, improving, promoting or otherwise commercializing Service or the aggregate data, but in no event shall such aggregated information include any personally identifying information.
We strive to provide you with choices regarding the personal information you provide to us. You may modify the personal information on your account at any time. However, such modifications or deletions will only affect reports after the date of such modifications; any data associated with prior incident reports will remain unmodified as previously provided to your recipients and stored in our servers. You also have control over which recipients will receive your incident reports and what profile data you elect to include and make accessible.
B. Location Information. You can choose whether or not to allow Service to collect and use real-time information about your device's location through the device's privacy settings. If you block the use of location information, some parts of Service may then be inaccessible or not function properly which will degrade our ability to provide accurate and timely service and/or incident reports.
C. You can choose whether or not to allow Service to collect and use real-time audio and/or visual information from your device during an incident initiated by you or during the usage of Service, through the Service settings or your device settings. If you block the transmission and/or use of audio and/or visual information, some parts of Service may then be inaccessible or not function properly which will degrade our ability to provide accurate and timely service and/or incident reports.
